Experts at ADER HABER reveal trends and unsolved challenges of Motor third party liability insurance
In the article exclusively for the Ukrainian Law Firms: A Handbook for foreign Clients Tatiana Daniltseva, Partner at ADER HABER, and Stas Karpov, Attorney, Senior Associate at ADER HABER, describe current defects and vulnerabilities in legal regulation and emphasize the necessity of the changes introduced by the Draft Law №3670-d.
Examining the Draft, experts note that certain novelties introduced by it have already been applied in other legislative acts, namely: conclusion of insurance e-agreements and implementation of direct settlement of loss.
Meanwhile, the Draft still presents a range of novelties on policyholders and aggrieved persons rights protection, namely on: arrangement of insurer’s payment terms and fines for a delay of payment; evaluation of damages without taking into account “wear and tear” and non-application of franchise; compensation by an insurer of the policyholder’s expenses in case of sole recovery by the latter; management of MTIBU claim payments in case of insurer’s insolvency.
Finally, experts consider that despite not curing all existing issues, the Draft still suggests the main global insurance trends and consumers’ interests.
