The criminal law practice team of ADER HABER successfully defended in court the client’s officials – the operator of the country’s critical infrastructure – in proceedings concerning the determination of a preventive measure in criminal proceedings relating to the commission of serious and especially serious criminal offenses.

The attorneys of ADER HABER argued that there were no legal grounds for the imposition of 24-hour house arrest on the suspects, as requested by the prosecution, due to the absence of reasonable suspicion and the lack of substantiated risks asserted by the prosecution.

As a result of the court’s consideration, a preventive measure in the form of a personal undertaking was applied to the Chief Executive Officer, while only one obligation was imposed on the other person – to appear upon first summons before the investigator, prosecutor, or court.

This case once again demonstrates that the imposition of significant restrictions on a person’s rights cannot be based solely on the severity of the alleged criminal offenses and requires proper procedural justification.
